Agreement Acceptance
By accessing our website, engaging our services, or participating in our sales representative program, you agree to be bound by these Terms of Service. This agreement is effective immediately upon:
- Clicking "I Accept" on any service agreement
- Making a payment for any of our services
- Signing a sales representative agreement
- Using any of our digital portals or platforms
Capacity and Authority
By entering into this agreement, you represent that you are at least 18 years old, have the legal capacity to enter into binding contracts, and (if acting on behalf of a business entity) have the authority to bind that entity to these terms.
2. Service Packages and Professional Scope
Service Packages
Audio & Hooks Studio offers four service packages. Each package comes with a detailed Service Agreement that incorporates the full numbered Scope of Work. Links to per-package agreements appear in the section below. Purchasing any package constitutes acceptance of the applicable Service Agreement.

- • On-hold music (5 min seamless loop)
- • Unlimited revisions (30-day window)

Enterprise Retainer - $60K/year
- • Everything in Premium Suite
- • Up to 4 new tracks annually
- • Quarterly audio check-ins
- • Priority 14-day turnaround
- • Dedicated account manager
Service Agreements and Scope of Work
Each package has a detailed Service Agreement that lists every contracted deliverable by number, with full specifications. These Agreements are incorporated into these Terms of Service by reference. Purchasing a package constitutes your acceptance of the applicable Service Agreement and its numbered Scope of Work.
Professional Standards
- Quality Assurance: All deliverables meet professional broadcast standards and are suitable for commercial use
- Revision Process: Revisions must be requested within specified timeframes and clearly articulated in writing
- Timeline Adherence: Project timelines are estimates; actual delivery may vary based on revision complexity
- Communication: Primary communication occurs through designated portals and scheduled consultations
Add-On Services
Additional services are available à la carte and subject to separate pricing:
Extra revision rounds - $350
Alternate genre remixes - $1,500
Radio voice-over tags - $500
A/B testing analysis - $1,500
Local market re-singers - $300
Behind-the-scenes content - $500
3. Payment Terms and Financial Obligations
Payment Structure
Project-Based Services (Launch, Growth, Premium)
- 50% Deposit: Required upon contract execution before work begins
- 25% Progress Payment: Due upon first-draft approval
- 25% Final Payment: Due upon final delivery and acceptance
Enterprise Retainer Services
- Quarterly Billing: $11,250 invoiced quarterly in advance
- Track Rollover: Unused track allocations roll over within the same contract year
- Auto-Renewal: Contracts automatically renew unless 60-day written notice is provided
Payment Processing and Terms
- Payment Methods: Credit cards, ACH transfers, and wire transfers accepted
- Payment Due: Net 15 days from invoice date unless otherwise specified
- Late Fees: 1.5% per month on overdue balances
- Currency: All prices quoted in U.S. Dollars
- Taxes: Client responsible for applicable sales tax, VAT, or other taxes
Refund and Cancellation Policy
Important: Creative services are time-sensitive and resource-intensive. Refund policies are strictly enforced.
- Deposits: Non-refundable once work begins (typically within 48 hours of payment)
- Progress Payments: Non-refundable once first draft is delivered
- Cancellation: Must be in writing; client liable for work completed plus 25% restocking fee
- Retainer Cancellation: 60-day written notice required; no refund for current quarter
4. Sales Representative Program
Independent Contractor Relationship
Sales representatives are independent contractors, not employees. This classification carries specific legal and tax implications.
- 1099 Classification: Representatives receive Form 1099-NEC and are responsible for self-employment taxes
- Business Operations: Representatives operate their own business and may work with other companies
- No Employee Benefits: No health insurance, paid time off, or traditional employee benefits provided
- Schedule Flexibility: Representatives set their own schedules and work methods
Commission Structure
Standard Commission: 15%
- • Launch Theme: $1125
- • Growth Pack: $1800
- • Premium Suite: $3300
- • Enterprise Retainer: $9000
Performance Incentives
- Up-sell residuals: 10% within 90 days
- Volume bonus: +3% above $75k monthly
- Retention bonus: 5% on renewals
Payment Terms
- Payment Trigger: Commission paid upon client's deposit receipt and contract execution
- Payment Schedule: Twice monthly via ACH (15th and last business day)
- No Chargebacks: Commissions not subject to clawback for completed transactions
Representative Obligations
- Training Completion: Must complete and pass all required training modules
- Professional Conduct: Maintain professional standards in all client interactions
- Accurate Representation: Provide truthful information about services and pricing
- Confidentiality: Protect client information and company trade secrets
- Non-Circumvention: Cannot directly contract with referred clients for similar services
